Unconstitutionality of delegating coercive enforcement powers to private actors in Ecuador

Abstract

This study examined the constitutionality of delegating coercive enforcement powers to private parties in Ecuador, understood as the transfer of a public authority for compulsory debt collection that, by its nature, falls within the sphere of state action and is subject to specific constitutional limits. The purpose of the research was to assess potential infringements of principles and guarantees such as legality, due process, legal certainty, and effective judicial protection. A qualitative study with an analytical-legal design was conducted, based on the review of the current legal framework, the analysis of constitutional case law, and the comparison between administrative coercive enforcement and judicial enforcement proceedings. The findings showed that coercive enforcement retains an administrative nature and that its scope should be confined to the patrimonial sphere; therefore, the imposition of personal measures or guarantees without prior judicial review was found to be incompatible with Ecuador’s constitutional model. The study also revealed that certain administrative interpretations have fostered situations of imbalance between the Public Administration and individuals subject to enforcement proceedings. In this context, Judgment No. 62-19-IN/23 acquired particular significance by defining the limits of coercive enforcement powers, invalidating provisions that allowed delegations without sufficient legal authorization, and reaffirming the need for prior judicial authorization before adopting personal measures. It was concluded that the recovery of public debts must be carried out within the limits established by the Constitution, ensuring that administrative efficiency does not undermine the fundamental rights of individuals subject to administrative action.
