Abstract

The purpose of this article is to determine the validity of digital evidence in Ecuadorian civil proceedings through a legal-doctrinal reflection aimed at properly establishing its evidentiary value while respecting the principles of rational evaluation of evidence and judicial reasoning to guarantee due process and its transparency. For this reason, the research followed a qualitative, documentary-based methodology, examining legal regulations such as the Constitution of the Republic of Ecuador, the General Organic Code of Proceedings, and the Law on Electronic Commerce, Electronic Signatures and Data Messages, among others. Based on this analysis, the study seeks to distinguish legal recognition, admissibility, and the determination of evidentiary values. The mere fact that evidence is presented in a digital format does not make it sufficiently reliable to be accepted as conclusive proof, nor does it justify its immediate rejection. The challenge lies in finding a balance that allows the authenticity, reliability, origin, and corroboration of digital evidence to be assessed in relation to all the evidence presented. The conclusion of this reflection is that these criteria provide a basis for guiding the rational evaluation of evidence, contributing to a reasoned interpretation that safeguards procedural rights and is compatible with Ecuadorian civil proceedings.
